On March 25, 2014, the Pricing Policy Division of the Federal Communications Commission’s (FCC) Wireline Competition Bureau issued an Order that outlines the deadlines and procedures for price-cap and rate-of-return incumbent carriers (ILECs) subject to §§61.382 and 61.393 of the FCC’s Rules for filing their 2014 annual access charge tariffs and Tariff Review Plans (TRPs). Tariffs will go into effect July 1, 2014.

Michael B. Hazzard is a partner in the Communications, Technology & Mobile Group. He is an internationally recognized legal and policy expert in the application of law and regulation to evolving technological deployment models involving cloud communications, Software as a Service, and mobile applications. Mike is one a select few lawyers with the breadth and depth of experience to represent emerging communications companies’ multiple legal verticals, including corporate formation, deal negotiations, government investigation, regulatory policy, and federal court litigation.
Mike counsels companies on competitive and regulatory issues associated with existing and emerging technology offerings. He helps ensure that new offerings comply with existing regulations, and he works to secure changes in regulation to enable improved technology and services to come to market. He also works with investors evaluating the risks and opportunities presented by market developments. Mike has particular expertise in representing companies before the Federal Communications Commission and the Federal Trade Commission.
Mike also serves as lead litigation counsel in cutting-edge communications matters before federal courts of appeals, federal district courts, state courts, and state public service commissions. Recent representative litigations matters have involved the Communications Act, the Federal Trade Commission Act, the Telephone Consumer Protection Act, the Telemarketing Sales Rule, and the Do Not Call List.
Mike has drafted and negotiated technology-related agreements regarding cloud computing, collocation, distance learning, equipment purchases/leases, mobile marketing, mobile virtual network operations, network interconnection, privacy policies, software as a service, software licensing, and various forms of terms of service.

On March 27, 2014, the Federal Communications Commission (FCC) granted, in part, the petition for expedited declaratory ruling filed by GroupMe, Inc./Skype Communications S.A.R.L. (GroupMe) on March 1, 2012, ruling that GroupMe does not need to obtain a message recipient’s consent directly, but can instead rely on intermediaries to obtain the necessary consent.
On January 22, 2014, the Consumer and Governmental Affairs Bureau of the Federal Communications Commission (FCC) released a public notice seeking comment on the Retail Industry Leaders Association’s (RILA) petition for declaratory ruling filed on December 30, 2013. Comments are due February 21, 2014, and reply comments are due March 10, 2014.
